People's Committee of Xuan Loc District
I. FUNCTIONS OF THE DISTRICT PEOPLE'S COMMITTEE:
 
            As a local state administrative agency, it is responsible to the People's Council of the same level and the state agency at a higher level.
 
The People's Committee is responsible for implementing the Constitution, laws, documents of higher-level state agencies and resolutions of the People's Council at the same level to ensure the implementation of policies and measures for socio-economic development, strengthening national defense and security and implementing other policies in the locality.
 
The People's Committee performs the function of state management at the local level, contributing to ensuring unified direction and management in the state administrative apparatus from the central to local levels.
 
The People's Committee elected by the People's Council is the executive body of the People's Council, the local state administrative agency, responsible to the People's Council of the same level and the higher-level state agency.

           II. DUTIES - POWERS OF THE DISTRICT PEOPLE'S COMMITTEE
 
 1. In the economic field, the District People's Committee performs the following tasks and powers:
 
 1.1. Develop master plans for socio-economic development, sectoral development, urban and rural development within the scope of management; develop long-term and annual plans for socio-economic development of the district and submit them to the People's Council for approval and submission to the Government for approval;
 
1.2. Participate with central ministries and branches in economic zoning; develop programs and projects of provinces, central ministries and branches; organize and inspect the implementation of assigned tasks of programs and projects;
 
1.3. Prepare estimates of state budget revenue in the locality; prepare estimates of local budget revenue and expenditure; prepare plans for allocating the budget estimates of one's level to submit to the People's Council of the same level for decision; prepare estimates to adjust the local budget when necessary; finalize the local budget to submit to the People's Council of the same level for consideration in accordance with the provisions of law;
 
1.4. Direct and inspect tax authorities and agencies assigned by the State to collect local budgets according to the provisions of law;
 
1.5. Develop a plan for collecting fees, charges, contributions from the people and capital mobilization levels to submit to the People's Council for decision;
 
1.6. Develop a project to decentralize investment spending on construction of local socio-economic infrastructure works according to the provisions of law to submit to the People's Council for decision; organize and direct the implementation of the project after it is approved by the People's Council;
 
1.7. Establish a financial reserve fund in accordance with the provisions of law, submit it to the People's Council of the same level and report to the higher-level financial authority;
 
1.8. Exercise the right to represent the owner of the State's capital contribution in enterprises and the right to represent the owner of land in the locality according to the provisions of law.
 
2. In the fields of agriculture, forestry, fishery, irrigation and land, the District People's Committee performs the following tasks and powers:
 
2.1. Direct and inspect the implementation of planning and development plans for agriculture, forestry, fishery, and irrigation; agricultural, forestry, and fishery extension programs; production development and protection of crops and livestock in the district;
 
2.2. Directing the implementation and inspection of the production and use of plant varieties, livestock breeds, animal feed, pesticides, fertilizers, veterinary medicines and biological products serving agriculture;
 
 
2.3. Develop land use planning and plans to submit to the People's Council of the same level for approval before submitting to the Government for approval; review and approve land use planning and plans of the People's Committee of the next lower level; decide on land allocation, land recovery, land lease, and settlement of land disputes; inspect land management and use and perform other tasks as prescribed by law;
 
2.4. Directing and inspecting the planting and protection of upstream forests, special-use forests, and protective forests according to planning; organizing forest exploitation according to Government regulations; directing and inspecting the farming, fishing, processing, and protection of aquatic resources;
 
2.5. Direct and inspect the exploitation and protection of water resources; construct, exploit and protect medium and small-sized irrigation works; manage and protect the dike system and flood prevention and control works; direct and mobilize forces to prevent and overcome the consequences of natural disasters and floods in the district.
 
3. In the field of industry and handicrafts, the District People's Committee performs the following tasks and powers:
 
3.1. Develop plans and projects for industrial and handicraft development in the district; organize state management of industrial and handicraft enterprises in the district according to authority;
 
3.2. Organize the implementation of industrial development programs and projects, build and develop industrial parks, export processing zones, and economic zones according to approved plans; direct and inspect the construction and development of industrial clusters, trade, services, tourism, and traditional industries, occupations, and craft villages in the district; develop agricultural, forestry, and aquatic product processing facilities and other industrial facilities;
 
3.3. Organize the protection of unexploited mineral resources in the locality; organize and inspect the exploitation of mineral resources in the locality.
 
4. In the field of transportation, the District People's Committee performs the following tasks and powers:
 
4.1. Direct and inspect the development and implementation of plans and projects for the district's transport network in accordance with the overall development scheme and central transport program planning;
 
4.2. Organize the management of urban traffic works, roads and inland waterways in the locality according to the provisions of law;
 
4.3. Organize the implementation of technical safety inspection and assessment of road and inland waterway vehicles; inspect and issue vehicle circulation permits, inland waterway vehicles and driving licenses according to the provisions of law;
 
4.4. Organize and direct the inspection and protection of traffic works and ensure traffic safety in the district.
 
5. In the field of urban construction, management and development, the District People's Committee performs the following tasks and powers:
 
5.1. Organize the preparation, submission or approval of regional and urban construction plans within the district; manage architecture, construction and construction land according to approved plans; approve investment plans and projects for construction works within its authority; manage construction work and grant construction permits within the district;
 
5.2. Managing investment, exploitation and use of urban infrastructure works, urban areas, rural residential areas; managing the implementation of housing and land policies; managing state-owned housing funds assigned by the Government;
 
5.3. Develop planning and development plans for construction materials; manage the exploitation, production and trading of construction materials in the district according to authority.
 
6. In the fields of trade, services and tourism, the District People's Committee performs the following tasks and powers:
 
6.1. State management of assigned types of schools and classes in the district; directly manage pedagogical colleges, vocational secondary schools, high schools, and cultural supplementary schools; train and foster teachers in the district from pedagogical college level and below; permit the establishment of non-public schools in accordance with the provisions of law;
 
6.2. Manage and inspect the implementation of teacher standards, examination regulations and diploma granting according to the provisions of law;
 
6.3. Conduct inspections and examinations of education and training work in the district according to the provisions of law.
 
7. In the fields of culture, information, physical training and sports, the District People's Committee performs the following tasks and powers:
 
7.1. State management of cultural, information, advertising, press, publishing, and sports activities according to the provisions of law; organization and management of public service units on culture, information, sports, radio, and television of the district;
 
7.2. Organize or be authorized to organize national and international exhibitions, fairs, cultural and sports activities in the district;
 
7.3. Direct and organize the implementation of protection, restoration and conservation of historical - cultural relics and scenic spots, cultural and artistic works according to authority; guide the building of civilized lifestyles and cultured families;
 
7.4. Inspect and prevent the trading and circulation of reactionary and obscene books, newspapers and cultural products.
 
8. In the field of health and social affairs, the District People's Committee performs the following tasks and powers:
 
8.1. Manage the operations of district medical units and grant licenses to practice private medicine and pharmacy;
 
8.2. Direct and inspect the implementation of measures to protect people's health; protect and care for the elderly, the disabled, and orphans; protect and care for mothers and children; implement population policies and family planning;
 
8.3. Direct and inspect the implementation of preferential policies, care and assistance for war invalids, sick soldiers, families of martyrs, people and families with meritorious services to the country;
 
8.4. Implement plans and measures on labor use and settlement of labor relations; solve employment problems and mobilize residents within the district;
 
8.5. Implement policies on labor protection, social insurance, social relief, hunger eradication, poverty reduction, and improvement of people's lives; guide the implementation of charity and humanitarian work; prevent and combat social evils and epidemics in the locality.
 
9. In the fields of science, technology, natural resources and environment, the District People's Committee performs the following tasks and powers:
 
9.1. Direct and inspect the implementation of specific tasks and plans for science, technology development and environmental protection; implement measures to encourage research, promote technical innovation initiatives, and apply scientific and technological advances to serve production and life;
 
9.2. Direct and inspect the implementation of measures to manage and use land, forests, mountains, rivers, lakes, water resources, underground resources, and marine resources in the locality according to the provisions of law;
 
9.3. Manage district-level scientific research programs and topics or those assigned by superiors; manage technology transfer activities, participate in state technology appraisal for important local investment projects;
 
9.4. Direct, organize and inspect the protection and improvement of the environment; prevent, combat and overcome the consequences of natural disasters, storms and floods, environmental degradation, environmental pollution and determine the responsibility for environmental treatment for organizations and individuals according to the provisions of law;
 
9.5. Direct, inspect and examine the implementation of legal provisions on measurement standards and product quality; radiation safety and control; industrial property; compliance with policies and laws on science, technology and environmental protection in the locality; prevent the production and circulation of counterfeit goods and protect the interests of consumers.
 
10. In the fields of national defense, security, social order and safety, the District People's Committee performs the following tasks and powers:
 
10.1. Ensure political security, social order and safety, build the People's Public Security force; direct the fight against crime, corruption, smuggling and commercial fraud; protect state secrets, build a mass movement to protect security, order and social safety; manage and inspect the transportation and use of weapons, explosives, flammable substances, toxic substances and radioactive substances; manage special business lines according to the provisions of law;
 
10.2. Direct and inspect the implementation of legal regulations on household registration management; manage the residence and travel of foreigners in the locality;
 
10.3. Implement measures to build the armed forces and national defense; direct the work of national defense education among the people and local schools; organize and direct the implementation of the plan to build the district into a solid defense zone; direct the construction and combat operations of local troops and militia; direct and inspect the organization of the implementation of the Law on Military Service; build reserve forces and mobilize forces when necessary, meeting the requirements of the locality and the whole country in all situations;
 
10.4. Direct and organize the implementation of on-site logistics tasks, military rear policies and policies towards local people's armed forces; combine national defense and security with economy, economy with national defense and security; organize the management and protection of national defense works and military zones in the district.
 
11. In implementing ethnic and religious policies, the District People's Committee has the following duties and powers:
 
11.1. Organize, direct and inspect the implementation of laws and ethnic policies; organize and direct the implementation of measures to ensure conditions for improving the material and spiritual life and raising the intellectual level of ethnic minorities, remote and disadvantaged areas;
 
11.2. Ensure the implementation of equality among ethnic groups, maintain and strengthen solidarity and mutual assistance among local ethnic groups;
 
11.3. Develop and organize the implementation of district programs and projects for ethnic minority areas, remote areas and areas with special difficulties;
 
11.4. Consider and resolve requests to repair local people's religious, belief and worship facilities in accordance with the law; handle acts of violating freedom of belief and religion or taking advantage of belief and religion to violate the law and State policies in accordance with the law.
 
12. In the field of law enforcement, the District People's Committee performs the following tasks and powers:
 
12. 1. Organize, direct and inspect the implementation of the Constitution, laws, legal documents of superior state agencies and resolutions of the People's Council of the same level; organize the implementation of legal propaganda and education work in the locality;
 
12.2. Direct the implementation of measures to protect the assets of agencies and organizations, protect the lives, freedom, honor, dignity, property, and other legitimate rights and interests of citizens;
 
12.3. Organize and direct state inspection work, organize citizen reception, resolve complaints, denunciations and recommendations of citizens according to the provisions of law;
 
12.4. Organize and direct the execution of judgments in the locality according to the provisions of law;
 
12.5. Organize and direct the management of civil status; perform notarization, judicial appraisal, manage the organization of lawyers and legal consultants according to the provisions of law;
 
12.6. Organization of registration and management of civil status with foreign elements.
 
13. In the construction of government and management of administrative boundaries, the District People's Committee performs the following tasks and powers:
 
13.1. Organize and direct the implementation of the election of National Assembly deputies and People's Council deputies according to the provisions of law;
 
13.2. Develop a project to establish specialized agencies under the People's Committee according to the Government's instructions and submit it to the People's Council for decision;
 
13.3. Regulate the organization, apparatus, tasks and specific powers of specialized agencies under the People's Committee at the same level;
 
13.4. Decide on the establishment of public service and career units based on the planning and guidance of competent state agencies; implement state management of central agencies, organizations and units located in the district;
 
13.5. Allow the establishment, dissolution, and equitization of state-owned enterprises; grant and revoke licenses to establish enterprises and companies; allow domestic economic organizations to set up representative offices and branches to operate in the district in accordance with the provisions of law;
 
13.6. Permit the establishment of associations; manage, guide and inspect the establishment and operation of associations in accordance with the provisions of law;
 
13.7. Decide on the allocation of administrative and career staffing targets for affiliated units and district-level People's Committees; direct and inspect the implementation of the mechanism of autonomy and self-responsibility for tasks, finance and organization for career units according to the Government's decentralization;
 
13.8. Organize training and retraining of state officials, civil servants and commune-level officials, and foster state management knowledge for People's Council delegates at district and commune levels according to the Government's guidance;
 
13.9. Develop a project to establish new, merge, divide, and adjust administrative boundaries and submit it to the People's Council of the same level for approval and submission to the competent authority for consideration and decision;
 
13.10. Direct and inspect the management of records, landmarks, boundaries and administrative boundary maps of the district and administrative units within the district;
 
13.11. Develop a plan to name and rename streets, roads, squares, and public works in the district and submit it to the People's Council for consideration and decision.
